Terms of Service

These Terms govern access to and use of BlueCollar, including the mobile application, websites, beta versions, and related services provided by ATCODE LLC.

1. Agreement and eligibility

By creating an account, accepting an invitation, purchasing a subscription, or using BlueCollar, you agree to these Terms. You must be legally able to enter into this agreement and must provide accurate account and business information.

2. Business accounts and authority

If you use BlueCollar for a company, you represent that you are authorized to act for that company. The account owner or designated administrators may invite users, assign roles, set permissions, and manage company information. The company is responsible for the activities of its users and for obtaining any permissions needed to enter customer, employee, job, photo, communication, and other information into BlueCollar.

3. Acceptable use

You may not use BlueCollar to violate law, infringe rights, harass others, send unlawful or unsolicited communications, access another company’s information without authorization, introduce malicious code, interfere with security, reverse engineer restricted components, or misuse the service in a way that creates unreasonable risk or load.

4. Subscriptions and trials

BlueCollar may offer free trials, monthly subscriptions, annual subscriptions, website-based business plans, or other plans. Current launch pricing is expected to be $120 per month or $1,200 per year after a seven-day trial, but pricing and plan availability may change before or after launch as allowed by law and the applicable purchase platform.

Subscriptions may renew automatically unless canceled through the platform used for purchase. Apple-billed subscriptions are managed through the user’s Apple Account. Website purchases may be managed through the applicable billing portal. Canceling stops future renewal but generally does not create a refund for a period already purchased, except where required by law or platform rules.

5. Beta service

Beta versions may contain errors, incomplete features, temporary data, or service interruptions. Features may change or be removed. Do not rely on a beta version as the only record for critical business, safety, legal, payroll, financial, or emergency information. Maintain appropriate backups and operating procedures.

6. Customer and employee communications

You are responsible for ensuring that messages, calls, notifications, and other communications sent through or initiated by BlueCollar comply with applicable consent, privacy, employment, consumer-protection, and anti-spam laws. Carrier, messaging, and data charges may apply.

7. User content

You retain ownership of information and content you submit. You grant ATCODE LLC a limited license to host, process, transmit, display, reproduce, and otherwise use that content only as reasonably necessary to operate, secure, support, and improve BlueCollar and comply with law. You represent that you have the rights and permissions required to submit the content.

8. Intellectual property

BlueCollar, its software, design, branding, documentation, and related materials are owned by ATCODE LLC or its licensors and are protected by applicable intellectual-property laws. These Terms provide a limited, revocable, non-transferable right to use the service as intended; they do not transfer ownership.

9. Third-party services

BlueCollar may depend on third-party platforms and services, including app stores, hosting, authentication, messaging, payment, and storage providers. Their terms and availability may also apply. ATCODE LLC is not responsible for third-party outages, decisions, or services outside its reasonable control.

10. Suspension and termination

We may limit, suspend, or terminate access for nonpayment, security risk, legal requirement, misuse, material breach, or to protect users or the service. You may stop using BlueCollar at any time and may request account closure, subject to billing obligations and legally required retention.

11. Disclaimers

To the maximum extent permitted by law, BlueCollar is provided “as is” and “as available.” ATCODE LLC disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, and uninterrupted or error-free operation. BlueCollar is not an emergency, life-safety, legal, tax, payroll, accounting, or professional-advice service.

12. Limitation of liability

To the maximum extent permitted by law, ATCODE LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, customers, business opportunities, goodwill, or data. ATCODE LLC’s aggregate liability relating to BlueCollar will not exceed the greater of the amount paid for BlueCollar during the twelve months before the claim or one hundred U.S. dollars, except where a different limit is required by law.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless ATCODE LLC and its personnel from claims, losses, liabilities, and expenses arising from your content, your company’s use of BlueCollar, your violation of these Terms, or your violation of another person’s rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Unless prohibited by law, disputes will be brought in a state or federal court with jurisdiction in Texas. The parties will first attempt in good faith to resolve disputes informally.

15. Changes

We may update these Terms. Material changes may be communicated through the service, email, or website. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
